Bringing a Claim

Employment tribunals

It is not necessary for you to have been dismissed to be able to bring a claim against your employer. Certain statutory rights including the right to not be discriminated against can be enforced in an employment tribunal without the termination of your employment. However, other claims cannot be brought forward until there has been a dismissal.

You generally only have three months from the relevant act to bring a claim to an employment tribunal otherwise you may lose your right to bring a claim. This is due to your employer using the time scale as a defence unless you have a good reason for not presenting the case sooner.

  • Discrimination
    • You cannot be discriminated against on grounds of your age, disability, gender reassignment, marriage or civil partnership, pregnancy and maternity, race, religion, sex or sexual orientation.
  • Redundancy
    • Your employer is required to consult with you with a view of avoiding redundancy by allowing you to reduce your hours, agreeing a pay cut or finding you another job within the company.
  • Constructive, unfair and  wrongful dismissal
    • Constructive dismissal is when an employee resigns in consequence of a fundamental breach of the employment contract by the employer. Unfair dismissal is when you have been an employee with more than twelve months' continuous service at the time of your dismissal and wrongful dismissal is a dismissal by the employer in breach of contract.
