It is not necessary for you to have been dismissed to be able to bring a claim against your employer. Certain statutory rights including the right to not be discriminated against can be enforced in an employment tribunal without the termination of your employment. However, other claims cannot be brought forward until there has been a dismissal.
You generally only have three months from the relevant act to bring a claim to an employment tribunal otherwise you may lose your right to bring a claim. This is due to your employer using the time scale as a defence unless you have a good reason for not presenting the case sooner.
